Dr. Sayyid Sadiq Haqiqat thinks that the theory of coexistence has several pillars, one of which is the limited validity of political jurisprudence. In this session, l will only discuss its validity from an epistemological point of view; It must also be known that the discussion of political science is new and it is not an independent scientific field either.
In order to consider political jurisprudence as valid, Dr. Sadiq Haqiqat considers seven prerequisites necessary; The ruling of revelation confirms or limits the ruling of the intellect, jurisprudence is valid, rulings are continuous, there is no boundary between political and non-political issues, jurisprudence is a technique, in the paradigm of principlists, Taqlid/following a mujtahid is obligatory.
Political jurisprudence faces limitations; One cannot expect a theory of the state from jurisprudence, jurisprudence cannot have a theory of peace, the single message has authority with the fundamentalists, jurisprudence cannot have a system.
Dr. Mahdi Mujahidi, in criticizing the article of Dr. Sayyid Sadiq, stated the truth that when we talk about political jurisprudence, we are talking about a set of prescriptive statements; The summary of the article of Dr. Haqiqat in a few lines that political jurisprudence includes prescriptive statements within fiqh that have two characteristics, firstly, they are political and are removed from other prescriptive statements of jurisprudence, also because jurisprudence is valid, its components are also valid, thus, jurisprudence is also politically valid.
The two main problems of the article were that, firstly, the anthropological basis of the article was not clear, and secondly, due to the lack of basis, this article did not have a methodology, which caused contradictory content.
Due to the fact that the argument is specific to the claimant, thus we go to the claims; We don’t have a duality called revelation and reason. Why was the validity of jurisprudence assumed? Taqlid is obligatory when there is no systematic doubt about it. It is not possible to continue with all these differences due to the passage of time. The new government is different from the old government and the concepts covers a wide range and in other words it is totalitarian, the technology or technique of jurisprudence was the head of chapters to refute the claimants of Dr. Sadiq Haqiqat.
