The 23rd session was held on Sunday, November 17, 2024, with the topic of “The Method of Compiling a System of Legislative Jurisprudence Issues” at the Institute for Contemporary Jurisprudence Studies, with the presence of Hujjat al-lslam wa Muslimin Ali Akbarian as the presenter and Hujjat al-lslam wa Muslimin Dr. Muh. Javad Arista as the critic.
The best research structure in the jurisprudence of legislation is the structure of the jurists of the predecessors!
At the beginning of this meeting, Hujjat lslam wa Muslimin Hasan Ali Ali Akbarian presented his proposed structure and after explaining the concepts of the discussion from his perspective, he provided the audience with a list of his desired structure: I saw the best research structure in the jurisprudence of legislation as the structure of the jurists of the predecessors. This structure has characteristics, one of which is: tolerance meaning that they never “changed” the previous structures and the heritage of the predecessors, but rather “emerged” and in cases of conflict between the predecessor’s structure and new issues, they passed with tolerance.
The structure of the jurisprudence of legislation can be deduced from the procedural jurisprudence of the predecessors
A member of the faculty of the Research Institute of Islamic Sciences and Culture stated in concluding his discussions: The structure I accept is modeled after jurisprudential books whose discussion is a process, such as the Book of Prayer.
The structure of the jurisprudence of legislation must be relevant to today’s world while maintaining a connection with the predecessors
Continuing with Hujjat al-Islam wa al-Muslimin, Dr. Muh. Javad Arista stated: “The structure of legislative jurisprudence, while maintaining its connection with the heritage of the predecessors, must also be relevant to today’s world.”
Based on this thought, he stated: “Accordingly, one of the first issues of legislative jurisprudence is the legitimacy of legislation.”
