- Under the pretext of the availability of the book “Reason’s Right in Ijtihad” written by professor Shahid Morteza Motahari in the library of the Research Institute of Contemporary Jurisprudence, this book was examined and studied.
The present book consists of three articles and two lectures by Martyr Ayatollah Motahari. The articles reached us recently. The first article, which is published under the title “Ijtihad and its relationship with rational reasoning, goodness and ugliness”, its title was originally the principle of ijtihad in “Islam”, which was published in the third annual publication of “School of Shia”, but from there that a professor’s lecture under the same title of “Ijtihad in Islam” was given in a monthly gathering in Tehran between October 1339 and October 1341 and was included by the martyred thinker in the book Ten Talks, it was deemed necessary that the title of the first article of this book It should be changed so as not to be confused with the speech that is in the book of Ten Speeches. The second article of this book is “Reason’s Right in Ijtihad” which was published in the magazine “Maktab Shi’i” in May 1341, number 9, and of course the book was also called by the same name. And the article on the occasion of the 1000th anniversary of the death of Sheikh Sadouq and the 100th anniversary of the death of Sheikh Ansari (may God have mercy on them) was written and published in the magazine “Maktab Shi’i” in Shahrivar 1338, number 1.
In the first two articles, the right of reason in ijtihad has been thoroughly examined and researched, and it has been shown that the Shia jurists, inspired by their imams to derive the rulings of Islam, while accepting the rational goodness and badness of actions, neither followed the path of analogy nor They chose the path of a group called Ahl al-Hadith, who were found among the Sunnis, but they chose a middle path, and of course, among the original mujtahids, the opposition to analogy did not weaken the right of reason in ijtihad. Tenth, the Akhbaris were a group similar to the Ahl al-Hadith among the Sunnis in the first centuries, and the struggle of the Mujtahids against them has also been analyzed, and it has been warned that although Akhbarism failed in Shia, but the spirit of Akhbarism still exists in some jurists. But the title of those two lectures, which is placed after the articles, is “Inspiration from Sheikh Tusi”. These two lectures were delivered in April 1349 at Hosseiniyeh Irshad in Tehran on the occasion of the 1000th anniversary of Sheikh Tusi’s birth, and in addition to dealing with the life, position, and jurisprudential method and the two advantages of that great man, some current issues related to this topic were also discussed. has taken Of course, before these two speeches, the “Sheikh Tusi Millennium Congress” was held on March 28, 1348 to April 3, 1349 at the University of Mashhad (today’s Ferdowsi), where professor Motahari presented an article entitled “Inspiration from Sheikh Al-Taifah”. and it was published in Sheikh Tusi’s book Hazara by the efforts of the late Hojjat-ul-Islam Ali Devani along with other articles of the Congress, and after the martyrdom of Ayatollah Motahari, it was published in the book of Al-Ghadir and Islamic Unity. In this book, you can understand some points of the jurisprudential method of Ayatollah Motahari. It is hoped that this book, like the other works of that great Islamic scholar, will lead to more familiarity with Islamic teachings among the members of the society.
