“Chavush Artistic Cultural Magazine” is the title of a program that deals with the intellectual concerns of people of culture on the fourth channel in lran. 

 It is one of the recent programs of this magazine, with the topic of “Jurisprudence of Art”, was broadcast on the 4th channel of the Islamic Republic of Iran broadcasting.  In this program, Ayatullah Abul Qasim Ali Dust, professor of external studies at Qum seminary and member of the board of trustees of the Research Institute of Contemporary Jurisprudence and Hujjat ​​al-Islam wa al-Muslimin, Mustafa Durri, vice-president and research assistant of the Research Institute of Contemporary Jurisprudence and the director of the Islamic School of Jurisprudence of Art, discussed the issue of art jurisprudence. 

 Ayatullah Ali Dust, while pointing out that jurisprudence as the science that discovers the Divine law, is subordinate to the scope of the Shari’ah, emphasized that “We must see the jurisprudence as broader than the explanation of the issues of the scholars.”  He also added: “Art is one of those designations and phenomena that are definitely intended in Shari’ah law.  That is, we cannot say that the pure Islamic law has no opinion about art.  If we consider art in the general sense, it starts from the border of love.  Because I believe that the border of art is not obscenity, but love.  “Allah is beautiful and loves beauty”, this love brings about beauty.  Therefore, the bottom of the art is love, but this love can reach the limit of obligation;  It means that art becomes necessary in some places, which becomes a burden on the shoulders of the government, and on the shoulders of scholars, and in some places it may even reach the limit of sanctity.

 Hujjat al-Islam wal al-Muslimin Durry went on to explain the statements of Professor Ali Dust.  Referring to the functions of jurisprudence, he enumerated the triple missions of jurisprudence as follows: “The first mission of jurisprudence is to regulate behavior, the second mission is to support the legal system.  The third area that jurisprudence will address is the support of the preaching system, which the discussion of art jurisprudence is more related to this area.

 From the point of view of this professor, art jurisprudence should not be reduced to the way men and women relate, or women’s hijab;  Rather, “in the category of art, the knowledge of jurisprudence has newer and more important fields that it must respond to, and of course, it is now being discussed and answered in jurisprudential circles.”  For example, an important aspect is that in a performance that is now in the medium of cinema, theater or television, if a work promotes violence, what is the ruling on this in terms of jurisprudence?  If a work promotes consumerism, promotes worldliness, how can we deal with it?”

 Hujjat al-Islam wa al-Muslimin Durry, referring to the change of some issues and the need to examine them in the jurisprudence of art, said: “For example, some dances have gone out of the state of being a primitive and repulsive activity and have become a difficult art.  When I say this, I do not mean that it is halal because it is so.  I want to say that the nature of data has changed.  We have to make a new ijtihad in this field and discuss it.”

He also pointed to the need for continuous and effective communication between jurists and artists, and pointed to the establishment and activity of the Islamic School of Art in Qum and emphasized: “We must define a project and one part should be the responsibility of the jurist and the other part should be the responsibility of the artist. Let’s have a scientific discussion and a thematic discussion with you and jurisprudence with them.  It is normal communication that removes this communication and skepticism and misunderstandings in this regard.
