Ayatullah Ahmad Muballeghi, professor of al-Bahth al-kharij at Qum seminary, on the 6th of Khordad at the 13th scientific meeting “Application of jurisprudential propositions; Feasibility, Methods and Areas” which was organized by the Research Institute of Contemporary Jurisprudence Studies, stating that the purpose of practicalization is to objectify the Shari’ah in the field of reality, and in the technical term for this process, there are two methods of “tatbiq” and “tanzil”. He stated: If we consider two paths for application, one destination is “tanzil” and the other is “tatbiq”.
Saying that jurisprudence will not come to the contemporary arena if it is only understood by relying on the mentality of the past, Ayatullah Muballeghii said: Martyr Muttahari emphasizes the rules of jurisprudence in the mechanisms he defined for the continuity of Shari’ah law and mentions two components for this. One is to recognize the rules of jurisprudence, especially in terms of the subject, and the other is to recognize the contemporary situation.
He added: Part of the burden of application is on the shoulders of jurisprudence rules and we must accept that jurisprudence rules can be developed.
The teacher of the course outside the seminary stated that if we consider the Shari’ah to include areas, each of them has its own tanzil, referring to the field of manats, he said: Manats can be reduced in the body of institutions, activities, policies, etc.
Further, he criticized the traditional method of external studies and stated that we are used to redacting Manat and said: We have many manats that can be reduced and there is no room for deriving manats in our jurisprudence.
It should be noted that “Methodology” meetings are held on Sundays at the Institute of Contemporary Jurisprudence Studies.
